1. Introduction

This Overtime Policy serves as a comprehensive guide to understanding the procedures and compensation regarding overtime work within the organization. This policy is designed to align with Indian labor laws, including the Payment of Wages Act, 1936, and other relevant regulations, to address our business needs while ensuring the overall welfare of our employees.

2. Purpose

The purpose of this policy is to outline the conditions under which overtime may be required or approved, detail the methods of compensation, and establish the procedures for requesting and reporting overtime.

3. Scope

The overtime policy applies to all non-exempt employees who are eligible for overtime compensation as per federal and state labor laws. It does not cover exempt employees, who are not entitled to overtime pay under the Payment of Wages Act of 1936

4. Definitions

  • Overtime: Hours which are worked beyond the standard full-time workweek, which are typically 40 hours per week.
  • Non-Exempt Employees: Employees eligible for overtime pay as per the Payment of Wages Act, 1936
  • Exempt Employees: Employees not eligible for overtime pay, typically including managerial, professional, or administrative roles. 

 5.1 Eligibility

The overtime pay is provided to employees under Indian labor laws. For non-exempt employees, overtime compensation is typically available based on job responsibilities, salary, and legal criteria.

Example:

  1. Eligibility: In line with the Payment of Wages Act, of 1936, employees who work beyond the standard working hours (usually 48 hours per week) are eligible for overtime pay.
  2. Compensation Rate: Overtime pay is calculated at a rate of twice the employee’s regular hourly wage. For instance, if an employee’s regular hourly wage is ₹200, the overtime rate would be ₹400 per hour.

5.2 Authorization

  • All overtime work must receive prior approval from a supervisor or manager.
  • Overtime performed without pre-approval will not be compensated.
  • Employees are required to follow the established process for requesting overtime authorization.

 5.3 Rate of Compensation

  • Overtime is generally compensated at twice the regular wage rate.
  • This rate applies to hours worked beyond the standard workweek, subject to any specific agreements or legal requirements.

5.4 Recording and Reporting Hours

  • Employees must accurately record all hours worked, including overtime, using the company’s designated timekeeping system.
  • Any mistakes or errors in recorded hours should be reported to a supervisor for resolution.

6. Responsibilities

6.1: Employees

  • Ensure accurate recording of all hours worked.
  • Obtain necessary approvals for overtime before working additional hours.
  • Report any discrepancies or issues with overtime to their supervisor promptly.

6.2: Supervisors/Managers

  • Approve or deny overtime requests based on operational needs and budget considerations.
  • Monitor and manage overtime to ensure compliance with this policy.

7. Procedures for Disputes

Employees who believe there has been a violation of this policy or have disputes regarding overtime compensation should follow the company’s grievance procedures. This typically involves submitting a written complaint to Human Resources or the designated department, where it will be reviewed and addressed according to company procedures.

8. Review and Amendments

This policy will be reviewed annually and updated as necessary to reflect changes in laws, regulations, or company practices. Employees will be notified of any significant changes or updates to the policy.
